Online information session: changes to Fair Work legislation
The Federal Government’s Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 became law in December 2022.
The passage of this legislation will see a number of changes to Australia’s workplace relations framework in the months and years ahead.
For example the new laws:
- Prohibit pay secrecy clauses and clauses that prevent employees from discussing pay in employment contracts
- Aligns the Fair Work Act with other anti-discrimination legislation (for example to include protection against discrimination on the basis of breastfeeding, gender identity and intersex attributes)
- Prohibits sexual harassment in connection to work
- Limits fixed-term contracts (with a number of exceptions)
- Expands the grounds on which employees can request flexible work arrangements (including on the grounds of family and domestic violence, or pregnancy for example)
- Changes previous enterprise agreements (known as zombie agreements) and arrangements for bargaining at the enterprise level
- Expands the operation and potential for multi-enterprise bargaining
NDS is on the record voicing our concerns about the lack of consultation and potential unintended consequences of rushing reforms to Australia’s workplace relations framework of this magnitude through Parliament. Despite concerns raised by a number of industry sectors, however, the bill is now law.
NDS has engaged our external IR expert, Toby Halls, to brief providers on what the changes in this new legislation mean for disability service providers.
